It seems to be that it's enough under that statute for the AG to have a reasonable basis to believe that an offense might have occurred. I don't think he's required to provide anything more than that. Is this the correct standard?

Comment on THE MINNESOTA FALSE CLAIMS ACT IS SIGNED INTO LAW

I like your style, the fact that your site is a little bit different makes it so interesting, I get fed up of seeing same-old-same-old all of the time. Thanks.

I find mesmerizing the discussion of Attorney General Ken Cuccinelli's CID on UVa for M. Mann's potential fraud.

Please keep going with posts regarding it.

John

Comment on Is UVa Allowing a Political Bias to Inhibit Cooperation with the Virginia Attorney General?

Thanks for your comment. VFATA was enacted in 2002, and became law on Jan. 1, 2003. You are quite right that VFATA is not retroactive, but the award date of the grant itself is not determinative, it is the date of the false claim that is important. Also, simply because a grant consists of federal money does not mean Cuccinelli lacks jurisdiction. For example, state and local governments often get something called "block grants" from the federal government in which the feds grant a chunk of money to be used for certain general purposes--scientific and medical research are common examples. The feds pick the disease or the scientific problem, but the exact details (i.e., who gets the money, etc.) are left up to the state. So, if a state administers a block grant of money from the feds, is it federal money or state money? I can only give you a lawyer's answer--it would depend on many specifics, and it would not be a quick easy answer.

Comment on Is UVa Allowing a Political Bias to Inhibit Cooperation with the Virginia Attorney General?

There's going to be a lot of interest in this case. None of the grants were issued post-VFATA. His bid to obtain records is therefore almost certainly going to get tossed for lack of standing.

Comment on Is UVa Allowing a Political Bias to Inhibit Cooperation with the Virginia Attorney General?

There's going to be a lot of interest in this case. I am amazed by the strength of the one in California. I hope our state follows suit and makes it as good as California's. Not only will it bring money to the state, but it'll protect the population from inflated insurance prices.
